Apr 18, 2024 - Notice of final rule from the U.S. Department of Agriculture (USDA) Food and Nutrition Service (FNS) revising regulations governing the WIC food packages. The revisions align the WIC food package regulations with the current Dietary Guidelines for Americans and reflect recommendations made by the National Academies of Sciences, Engineering and Medicine (NASEM) in its 2017 report, "Review of WIC Food Packages: Improving Balance and Choice" while promoting nutrition security and equity. Among other things, this rule intends to provide WIC participants with a wider variety of foods that align with the latest nutritional science; provide WIC State agencies with greater flexibility to prescribe and tailor food packages that accommodate participants' special dietary needs and personal and cultural food preferences; provide foods in amounts that are more consistent with the supplemental nature of the Program; and strengthen support for individual breastfeeding goals to help establish successful long-term breastfeeding. This rule is effective June 17, 2024.

Apr 17, 2024 - The Centers for Medicare & Medicaid Services (CMS) is seeking comments on the reinstatement of an information collection titled "Skilled Nursing Facility and Skilled Nursing Facility Complex Cost Report." The information collected will be used to determine the cost weights for the skilled nursing facility (SNF) market basket, conduct payment adequacy analyses, and determine reasonable costs. Comments are due by May 17, 2024.

Apr 17, 2024 - Executive Order from the Office of the President revoking three executive orders related to COVID-19 – Executive Order 13910 of March 23, 2020, Executive Order 13991 of January 20, 2021, and Executive Order 13998 of January 21, 2021. This order also transfers the responsibilities of the Coordinator of the COVID-19 Response and Counselor to the President to the Director of the Office of Pandemic Preparedness and Response Policy (OPPR) and terminates the COVID-19 Response Coordinator and Deputy Coordinator of the COVID-19 Response positions.

Apr 16, 2024 - The Centers for Medicare & Medicaid Services (CMS) seeking comments on revisions to an information collection titled "Reform of Requirements for Long-Term Care Facilities." The information collected will be used by CMS, state survey agencies, and long-term care (LTC) facilities to ensure compliance with Medicare and Medicaid requirements and quality of care provided to LTC residents. Revisions include new requirements proposed at 42 CFR 483.35 and new section 483.71, which were discussed in the September 6, 2023, proposed rule on page 61391. Comments are due by June 17, 2024.

Apr 12, 2024 - The Centers for Medicare and Medicaid Services is seeking comments on the following information collections: 1) Transitional Coverage and Retroactive Medicare Part D Coverage for Certain Low-Income Beneficiaries through the Limited Income Newly Eligible Transition (LI NET) Program; and 2) Appointment of Representative and Supporting Regulations in 42 CFR 405.910, which says that an individual or entity may appoint a representative to act of their behalf when exercising their rights for claim determinations and appeals. Apr 11, 2024 - Notice from the Department of Defense (DOD) Director of the Defense Health Agency (DHA) announcing adjustments to the reimbursement and provider qualifications for childbirth support services under the Childbirth and Breastfeeding Support Demonstration (CBSD). The second phase of CBSD will include a new reimbursement methodology, new doula-specific codes, increased flexibility for antepartum and postpartum visits, and a new requirement for certified labor doulas (CLDs) to be participating providers. DHA also announces the National Black Doula Association (NBDA) as a certification body for CLDs and the certification requirement for doulas practicing in a state with an active state-wide doula Medicaid benefit will be waived when that doula is actively enrolled in that state Medicaid program. Phase 2 will be fully implemented by January 1, 2025, with a transition period beginning June 10, 2024. The modifications to the certified labor doulas (CLD) certification requirement are effective April 11, 2024.

Apr 11, 2024 - The Health Resources and Services Administration (HRSA) Bureau of Primary Health Care (BPHC) seeks comments on a draft Policy Information Notice (PIN) that proposes program policy guidance for health centers and look-alikes under section 330 of the Public Health Service Act. This draft PIN aims to clarify the circumstances under which health centers may provide certain health services as part of the Health Center Program scope of project to justice-involved individuals who are expected to be or scheduled for release from a carceral setting and re-enter the community within 90 days. This rule is effective May 10, 2024, except for amendments to sections 36.4 (amendatory instruction 2), 54.205 (amendatory instruction 7), 54.313 (amendatory instruction 10), 54.314 (amendatory instruction 11), 54.316 (amendatory instruction 13), 54.903 (amendatory instruction 18), and 54.1306 (amendatory instruction 22), which are delayed indefinitely.

RBS issued a notice of solicitation of applications on January 2, 2024, subject to the availability of funding, but did not receive the anticipated appropriations. Any applications submitted to date will not be funded through the RISE program.

Apr 3, 2024 - The U.S. Department of Agriculture (USDA) Rural Business-Cooperative Service (RBS) announces the availability of up to $3 million in competitive grants under the Socially Disadvantaged Groups Grant (SDGG) program for fiscal year 2024. The purpose of the SDGG program is to provide technical assistance to socially disadvantaged groups in rural areas through cooperatives and Cooperative Development Centers. Technical assistance includes feasibility studies, business plans, strategic planning, and leadership training. Applications are due by June 3, 2024.

Apr 3, 2024 - Notice of final rules from the Department of the Treasury, Department of Labor (DOL), and Department of Health and Human Services (HHS) amending the definition of short-term, limited-duration insurance, which is excluded from the definition of individual health insurance coverage under the Public Health Service Act. This notice also amends the regulations for hospital indemnity or other fixed indemnity insurance to be considered an excepted benefit in the group and individual health insurance markets. These regulations are effective June 17, 2024.

Apr 1, 2024 - Notice from the Centers for Medicare & Medicaid announcing that laboratories located in and licensed by the state of Washington and that possess a valid license under the Medical Test Site law, chapter 70.42 of the Revised Code of Washington, are exempt from the requirements of the Clinical Laboratory Improvement Amendments of 1988 (CLIA) for a period of 4 years. The exemption is effective April 1, 2024, to April 1, 2028.

Directs agency members of the White House Initiative on Women's Health Research – Secretary of Defense, the Secretary of Agriculture, the Secretary of Health and Human Services, the Secretary of Veterans Affairs, the Administrator of the Environmental Protection Agency, and the Director of the National Science Foundation – to develop or strengthen research and data standards that enhance the study of women's health across all relevant, federally funded research and other federal funding opportunities and prioritize grantmaking and other awards to advance women's health research. treatment program (OTP) accreditation, certification, and
standards for the treatment of opioid use disorder (OUD)
with medications for opioid use disorder (MOUD). These
changes include making flexibilities established during the
COVID-19 Public Health Emergency (PHE) permanent and
expanding access to care and evidence-based treatment for
OUD. This rule also removes all language and rules relating
to the Drug Addiction and Treatment Act (DATA) Waiver from
the regulations pursuant to the Consolidated Appropriations
Act, 2023. This rule is effective April 2, 2024, and the
compliance date is April 2, 2026.
